1. Introduction and Acceptance

These Terms of Service ("Terms") govern your use of the Kadamb Immigration website (kadambimmigration.com) and the immigration consulting services provided by Kadamb Overseas Pvt Ltd (India) in partnership with AICLA Global Pty Ltd (Australia), under the supervision of MARA-registered migration agent Feng Chen (MARN: 1577771).

By accessing our website, submitting an assessment form, or engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

2. Definitions

• "Kadamb Immigration" refers collectively to Kadamb Overseas Pvt Ltd (India) and AICLA Global Pty Ltd (Australia), operating under the brand name Kadamb Immigration.
• "Client" refers to any individual or entity that engages our services for immigration consulting, documentation, or visa application assistance.
• "MARA Agent" refers to Feng Chen, registered migration agent (MARN: 1577771), who provides regulated immigration advice and supervises visa applications.
• "Services" refers to immigration consulting, eligibility assessments, documentation preparation, skills assessment applications, visa application preparation and lodgment, and related advisory services.
• "Website" refers to kadambimmigration.com and all associated pages and content.

3. Services Provided

Kadamb Immigration provides the following services:

• Immigration consulting and eligibility assessment for Australian visa categories
• Documentation preparation and review for visa applications
• Skills assessment applications (ANMAC, VETASSESS, ACS, Engineers Australia, and other assessing authorities)
• Visa application preparation and lodgment through ImmiAccount
• Specialized report writing (GTE statements, career episodes, RPL reports)
• Employer-sponsored visa coordination (Subclass 482 and 186)
• State and territory nomination applications
• Post-lodgment follow-up and communication with the Department of Home Affairs
• General immigration guidance and information

4. Role Clarity and Service Structure

Kadamb Immigration operates through a structured partnership between India and Australia. It is important that you understand the role each entity plays in delivering our services:

4.1 Kadamb Overseas Pvt Ltd (India)

Role: Kadamb Overseas Pvt Ltd is responsible for client acquisition, initial screening and eligibility evaluation, documentation coordination and preparation, client liaison and communication, pre-lodgment counselling, and coordination with the Australian partner for visa processing.

Kadamb Overseas Pvt Ltd does not provide regulated immigration advice. All immigration advice is provided by the MARA-registered migration agent.

4.2 AICLA Global Pty Ltd and MARA Agent (Australia)

Role: AICLA Global Pty Ltd and MARA agent Feng Chen are responsible for providing MARA-compliant immigration advice, reviewing and approving visa applications, lodging applications with the Department of Home Affairs through ImmiAccount, managing all correspondence with Australian government bodies, and ensuring compliance with the Migration Act 1958 and the MARA Code of Conduct.

5. No Guarantee of Visa Outcomes

Kadamb Immigration does not and cannot guarantee the outcome of any visa application.

The decision to grant or refuse a visa rests solely with the Australian Department of Home Affairs. Our role is to provide professional guidance, prepare the strongest possible application, and ensure compliance with all legal requirements. However, the final decision on every visa application is made by the Department at its absolute discretion.

Any representation by any person associated with Kadamb Immigration that a visa outcome is guaranteed is unauthorised and should be reported to us immediately.

We commit to:

• Providing an honest and realistic assessment of your eligibility
• Advising you of any risks or weaknesses in your application
• Preparing a thorough and compliant application
• Keeping you informed of progress and any issues that arise

6. Fee Structure and Payment Terms

6.1 Fixed-Price Fees

Kadamb Immigration operates on a fixed-price fee structure. Before commencing work on your case, you will receive a detailed written fee quote that outlines all professional fees for the agreed scope of services. There are no hidden charges beyond the quoted amount for the agreed scope of work.

6.2 What Fees Cover

Our professional fees typically cover consultation and advice, document preparation and review, application preparation and lodgment, and post-lodgment follow-up. Unless specifically stated in the fee quote, our fees do not include government application charges (visa application charges payable to the Department of Home Affairs), skills assessment body fees (ANMAC, VETASSESS, ACS, etc.), English language test fees (IELTS, PTE, OET), health examination costs, police clearance fees, translation and notarization costs, or any other third-party charges.

6.3 Payment Terms

• An initial deposit is required before we commence work on your case, as specified in the fee agreement
• The balance of fees is payable according to the milestone schedule outlined in your engagement letter
• Payments can be made via bank transfer, as specified in the invoice
• All fees are quoted in Indian Rupees (INR) for services contracted through Kadamb Overseas Pvt Ltd, or in Australian Dollars (AUD) for services contracted directly with AICLA Global Pty Ltd
• Fees are non-refundable for work already completed at the time of cancellation, unless otherwise stated in the engagement letter

6.4 Fee Changes

Quoted fees are valid for a period of 30 days from the date of the quote. If you engage our services after this period, an updated quote may be provided. Changes in government charges, skills assessment fees, or other third-party costs are beyond our control and will be communicated to you as they occur.

7. Client Obligations

As a client of Kadamb Immigration, you agree to:

• Provide truthful and accurate information: All information you provide to us must be true, complete, and accurate. Providing false or misleading information can result in visa refusal, cancellation, or legal consequences under Australian immigration law.
• Respond in a timely manner: When we request documents, information, or instructions from you, please respond within the timeframe specified. Delays in providing information may affect processing times and application outcomes.
• Disclose material changes: You must promptly inform us of any changes to your circumstances that may affect your visa application, including changes in employment, marital status, health, character, or contact details.
• Attend required appointments: You must attend health examinations, biometrics appointments, interviews, or any other appointments required as part of your visa application process.
• Pay fees on time: Professional fees must be paid according to the agreed payment schedule. Failure to pay may result in suspension or cessation of services.
• Comply with visa conditions: If granted a visa, you must comply with all conditions attached to that visa. We can provide guidance on visa conditions but compliance is your responsibility.
• Not engage unregistered agents: You agree not to seek immigration advice from unregistered agents or submit applications independently while engaged with us, as this may compromise your case.

8. Intellectual Property

All content on the Kadamb Immigration website, including text, graphics, logos, images, design elements, and software, is the intellectual property of Kadamb Immigration or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

You may not:

• Reproduce, distribute, or republish any content from our website without prior written permission
• Use our brand name, logo, or any trademarks for any purpose without authorization
• Modify, adapt, or create derivative works based on our website content
• Use any automated tools, scrapers, or bots to access or extract content from our website

Documents prepared specifically for your visa application (such as submissions, cover letters, and specialized reports) are prepared for your exclusive use in connection with your application and may not be shared, reproduced, or used for any other purpose without our written consent.

9. Limitation of Liability

To the maximum extent permitted by law:

• Kadamb Immigration, its directors, employees, partners, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to our services, including but not limited to loss of income, loss of opportunity, or emotional distress resulting from visa refusal or delays.
• Our total liability for any claim arising from our services shall not exceed the total professional fees paid by you for the specific service giving rise to the claim.
• We are not liable for delays or failures caused by the Department of Home Affairs, skills assessment bodies, or any other government or third-party organization.
• We are not liable for consequences arising from information you provided that was inaccurate, incomplete, or misleading.
• We are not liable for changes in immigration law, policy, or processing requirements that occur after your application is lodged.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud or gross negligence.

10. Termination and Cancellation

10.1 By the Client

You may terminate our services at any time by providing written notice. Upon termination:

• Fees for work already completed are non-refundable
• Any outstanding fees for work completed become immediately payable
• We will provide you with copies of all documents prepared for your application
• We will transfer your case file in accordance with MARA requirements if you engage a new agent

10.2 By Kadamb Immigration

We reserve the right to terminate our engagement if:

• You provide false or misleading information
• You fail to respond to reasonable requests for information or documents within a reasonable time
• You fail to pay fees in accordance with the agreed payment schedule
• Continuing to act would place us in conflict with our legal or ethical obligations
• The professional relationship has broken down to the extent that effective service delivery is no longer possible

11. Confidentiality

We treat all client information as strictly confidential. Our obligations regarding confidentiality are governed by the MARA Code of Conduct and the Australian Privacy Act 1988. We will not disclose your information to any third party except as described in our Privacy Policy or as required by law.

You also agree to keep confidential any proprietary processes, fee structures, or internal procedures disclosed to you during the course of our engagement.

12. Website Use

By using our website, you agree to:

• Use the website only for lawful purposes and in accordance with these Terms
• Not attempt to gain unauthorized access to any part of the website or its underlying systems
• Not use the website to transmit any harmful, offensive, or unlawful content
• Not interfere with or disrupt the operation of the website

Information on our website is provided for general informational purposes only and does not constitute immigration advice. The content is subject to change without notice and may not reflect the most current immigration laws or policies.

13. Governing Law and Jurisdiction

13.1 Visa and Immigration Services

All visa application services, immigration advice, and related matters provided by AICLA Global Pty Ltd and MARA agent Feng Chen are governed by the laws of the Commonwealth of Australia, including the Migration Act 1958 (Cth) and associated regulations. Any disputes relating to immigration services shall be subject to the jurisdiction of the courts of Western Australia.

13.2 Consulting Agreement (India)

The consulting agreement between you and Kadamb Overseas Pvt Ltd for pre-lodgment counselling, documentation coordination, and client liaison services is governed by the laws of India. Any disputes relating to the consulting agreement shall be subject to the jurisdiction of the courts in Ahmedabad, Gujarat, India.

13.3 MARA Complaints

If you have a complaint about the conduct of our MARA-registered migration agent, you may lodge a complaint directly with the Office of the Migration Agents Registration Authority (OMARA). Information about the complaints process is available at www.mara.gov.au.

14. Dispute Resolution

In the event of a dispute arising from these Terms or our services, we encourage the following resolution process:

1. Direct Discussion: Contact us directly to discuss the issue. Many concerns can be resolved through open communication.
2. Written Complaint: If direct discussion does not resolve the matter, submit a written complaint to support@kadamboverseas.com outlining the issue and your desired resolution. We will acknowledge your complaint within 5 business days and provide a substantive response within 14 business days.
3. Mediation: If the complaint cannot be resolved through direct negotiation, either party may refer the matter to mediation through a mutually agreed mediator.
4. MARA Complaint: For complaints relating to the conduct of the registered migration agent, you may lodge a complaint with OMARA at any time, irrespective of this dispute resolution process.
5. Legal Proceedings: If mediation is unsuccessful, either party may commence legal proceedings in the appropriate jurisdiction as specified in Section 13.

15. Indemnification

You agree to indemnify and hold harmless Kadamb Immigration, its directors, employees, partners, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your breach of these Terms
• False, inaccurate, or misleading information provided by you
• Your violation of any applicable law or regulation
• Your failure to comply with visa conditions after grant

16. Force Majeure

Kadamb Immigration shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions or changes in law, system failures, strikes, or disruptions to communication networks.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. Entire Agreement

These Terms, together with our Privacy Policy, Disclaimer, and any engagement letter or fee agreement signed between you and Kadamb Immigration, constitute the entire agreement between you and Kadamb Immigration regarding the use of our website and services.

19. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services after any modifications constitutes acceptance of the updated Terms. For existing clients, material changes to these Terms will be communicated directly.
