These Terms of Service ("Terms") govern your use of the Kadamb Immigration website (kadambimmigration.com) and the immigration consulting services provided by Kadamb Overseas Pvt Ltd (India) in partnership with AICLA Global Pty Ltd (Australia), under the supervision of MARA-registered migration agent Feng Chen (MARN: 1577771).
By accessing our website, submitting an assessment form, or engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

Role: Kadamb Overseas Pvt Ltd is responsible for client acquisition, initial screening and eligibility evaluation, documentation coordination and preparation, client liaison and communication, pre-lodgment counselling, and coordination with the Australian partner for visa processing.
Kadamb Overseas Pvt Ltd does not provide regulated immigration advice. All immigration advice is provided by the MARA-registered migration agent.

Role: AICLA Global Pty Ltd and MARA agent Feng Chen are responsible for providing MARA-compliant immigration advice, reviewing and approving visa applications, lodging applications with the Department of Home Affairs through ImmiAccount, managing all correspondence with Australian government bodies, and ensuring compliance with the Migration Act 1958 and the MARA Code of Conduct.
Kadamb Immigration does not and cannot guarantee the outcome of any visa application.
The decision to grant or refuse a visa rests solely with the Australian Department of Home Affairs. Our role is to provide professional guidance, prepare the strongest possible application, and ensure compliance with all legal requirements. However, the final decision on every visa application is made by the Department at its absolute discretion.
Any representation by any person associated with Kadamb Immigration that a visa outcome is guaranteed is unauthorised and should be reported to us immediately.

Kadamb Immigration operates on a fixed-price fee structure. Before commencing work on your case, you will receive a detailed written fee quote that outlines all professional fees for the agreed scope of services. There are no hidden charges beyond the quoted amount for the agreed scope of work.
Our professional fees typically cover consultation and advice, document preparation and review, application preparation and lodgment, and post-lodgment follow-up. Unless specifically stated in the fee quote, our fees do not include government application charges (visa application charges payable to the Department of Home Affairs), skills assessment body fees (ANMAC, VETASSESS, ACS, etc.), English language test fees (IELTS, PTE, OET), health examination costs, police clearance fees, translation and notarization costs, or any other third-party charges.
Quoted fees are valid for a period of 30 days from the date of the quote. If you engage our services after this period, an updated quote may be provided. Changes in government charges, skills assessment fees, or other third-party costs are beyond our control and will be communicated to you as they occur.

All content on the Kadamb Immigration website, including text, graphics, logos, images, design elements, and software, is the intellectual property of Kadamb Immigration or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

Documents prepared specifically for your visa application (such as submissions, cover letters, and specialized reports) are prepared for your exclusive use in connection with your application and may not be shared, reproduced, or used for any other purpose without our written consent.

We treat all client information as strictly confidential. Our obligations regarding confidentiality are governed by the MARA Code of Conduct and the Australian Privacy Act 1988. We will not disclose your information to any third party except as described in our Privacy Policy or as required by law.
You also agree to keep confidential any proprietary processes, fee structures, or internal procedures disclosed to you during the course of our engagement.

All visa application services, immigration advice, and related matters provided by AICLA Global Pty Ltd and MARA agent Feng Chen are governed by the laws of the Commonwealth of Australia, including the Migration Act 1958 (Cth) and associated regulations. Any disputes relating to immigration services shall be subject to the jurisdiction of the courts of Western Australia.
The consulting agreement between you and Kadamb Overseas Pvt Ltd for pre-lodgment counselling, documentation coordination, and client liaison services is governed by the laws of India. Any disputes relating to the consulting agreement shall be subject to the jurisdiction of the courts in Ahmedabad, Gujarat, India.
If you have a complaint about the conduct of our MARA-registered migration agent, you may lodge a complaint directly with the Office of the Migration Agents Registration Authority (OMARA). Information about the complaints process is available at www.mara.gov.au.
In the event of a dispute arising from these Terms or our services, we encourage the following resolution process:
You agree to indemnify and hold harmless Kadamb Immigration, its directors, employees, partners, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
Kadamb Immigration shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions or changes in law, system failures, strikes, or disruptions to communication networks.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
These Terms, together with our Privacy Policy, Disclaimer, and any engagement letter or fee agreement signed between you and Kadamb Immigration, constitute the entire agreement between you and Kadamb Immigration regarding the use of our website and services.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services after any modifications constitutes acceptance of the updated Terms. For existing clients, material changes to these Terms will be communicated directly.
